何去何从的迷茫

今年四川的冬天特别冷。

入冬以来，西伯利亚的寒流一次次袭入川西平原。冬至过后，天色阴霾，寒风裹挟着雨雪，纷纷扬扬地落满枯萎的草叶。这段时间以来，周兴和的心境犹如窗外霉变的天空，阴郁到了极点。

哥白尼因为提出“日心说”，被世人视为异端，最后被教会活活烧死；达尔文因为提出“进化论”，被定为邪说，受到整个世界的嘲弄和攻击，还有人差点把他送上断头台。即使人类文明发展到今天，这样的情形也不容乐观。这几年，在中国特色的这块土地上，周兴和发明的新型建材，在社会推广过程中，可谓处处受阻，步履维艰。冥冥之中，他似乎走进了由高明魔术师设下的迷宫里，让人看得见的是鲜花和掌声，而摸不着的则是圈套与陷阱。

他的产品在城市推广处处受阻后，无奈之下，他只好委曲求全，采取“农村包围城市”的迂回战术，把目光转向了四川广大农村地区。几年间，他们在成都周边的汶川、北川、青川、什邡、彭州、都江堰等10余个区县，廉价为村民盖了上千栋房屋，这些房屋不用钢筋、水泥和传统的砖瓦，全部采用了他们自己生产的产品。虽然这些项目他们没赚到什么钱，但产品质量接受了实践的检验，星河公司逐渐扩大了影响，他们渐渐在广大农村站住了脚跟。

就在不久前，彭州大宝镇九峰村一个叫“丹卉山庄”农家乐老板，不知出于什么原因，不想支付几万元的修建费，竟声称星河公司给他修建的房屋存在质量问题——好了，当地建筑工程质量检测中心闻风而动，前来进行技术鉴定了。不知这家检测中心出于什么目的，让人费解的是，国家《建筑法》83条明明规定：“抢险救灾临时建筑和农民自建的低层房屋不适用本法。”国家又规定，3层以下房屋属于低层建筑，而“丹卉山庄”只有2层，这样的建筑，哪能有劳这家建筑鉴定中心风声鹤唳来做鉴定呢？可他们来了。

For some reasons, maybe he did not want to pay tens of thousands of yuan for the building construction, he claimed that there were quality problems in the house built by Xinghe Company - well, the local construction engineering quality testing center heard and came to proceed the technical evaluation. The purpose of this testing center was unknown, but it was hard to understand that Article 83 of the National Construction Law clearly stipulates: "This law does not apply to the temporary buildings for rescue and relief work and the low-rise houses built by farmers themselves." The state also stipulates that the buildings under three storeys belong to the low-rise buildings, while "Danhui Mountain Villa" only had two storeys. How could such building need such testing center to conduct the evaluation? But here they came.
叫人感到奇怪的是，这栋房屋完全是用轻质建材建设，他们无视国家对这种产品颁发的“重点新产品”、“重点环保创新产品”和“国家星火计划推广项目”的结论，竟搬来钢筋水泥和砖混结构房屋的设计建设标准，从地基基础、墙体结构到楼面板都按常规设计建设标准来进行鉴定。同时他们还不顾国家《建筑法》第4条的规定：“国家鼓励奖励建筑新材料、新工艺和新技术的运用。”如此一来，他们简单甚至粗暴地把“丹卉山庄”鉴定为“危房”！言之凿凿声称“此房存在严重安全隐患，严重不满足现行国家建筑抗震设计规范，以及建筑抗震设防烈度7度要求。”
What made people feelling strange was that the house used the lightweight building materials for construction completely, but they ignored the conclusion for this kind of product of "key new product", "key green innovative product" and "National Spark Plan Promotion Program" issued by the state, and applied the design and construction standards of reinforced concrete and brick structure buildings, to evaluate from the foundation, wall structure to the floor panels according to the conventional design and construction standards. At the same time, they also ignored Article 4 of the National Construction Law: "The state encourages and rewards the application of new construction materials, new processes and new technologies." In this way, they simply or even roughly identified "Danhui Mountain Villa" as a "dangerous building"! they claimed firmly that "this house has serious potential safety hazards, and seriously does not meet the requirements of current national seismic design code, as well as building seismic fortification intensity of 7 degrees.
民间有句俗语，叫住“抬头三尺有神灵”。意思就是说一个人做事要凭良心，不能去做昧心的事，冥冥之中头顶上有神灵看着你呢！不知是偶然还是必然，老天后来果然给了这家建筑鉴定中心无情的嘲讽——此事说来话长，留待后述，还是让我们回到当前的现实中来。

Whether by chance or by necessity, the heaven eventually gave the testing center a merciless sneer - it's a long story to tell, but let's just get back to the current reality.
由于这家建筑鉴定中心草率地鉴定，加之当地法院不顾事实错误地判决，这家山庄不但不付分文建设费，反而要向星河公司进行经济索赔几十万元。如此一来，在四川农村就产生了多米诺骨牌一样的效应——好呀，既然建筑检测中心都说这样的建筑是“危房”，法院判决不但可以不给钱，反而可以向对方索赔，这样的好事真是千载难逢！于是，一时间，星河公司已建和在建的工程，几乎都被卷到拒付建设款和经济索赔的官司之中。

In this way, there was a domino effect in rural Sichuan - well, since the building testing center said that such a building was "dangerous", and the court judged to claim for compensation instead of paying the construction fee, it was such a good thing once in a blue moon! As a result, almost all the projects that Xinghe Company built or was under construction had been involved in the lawsuits for non-payment of construction fees and financial claims.

“兴和吗？”正在周兴和烦恼至极一筹莫展时，他桌上的电话响了。打来电话的是他的法律顾问魏教授，魏教授大概知道了他目前的处境，想约他出去喝茶散心。
