缅甸商标法于2023年4月1日正式有效，申请人需要注意了！

Based on the latest updates, we would like to recommend the following necessary actions to prepare for the Grand Opening Day of the New Trademark Law:

Please be strongly noted that, failure to the deadlines set forth, the re-filed applications will be deemed as abandoned from registration, according to the New Trademark Law and its regulations.

We are committed to providing you with the most up-to-date information, reliable advice, and prompt actions, in order to ensure the trademark application filings will be completed on time, allowing your clients to enjoy the Grand Opening date as the earliest filing date.

缅甸知识产权局公布最新的商标法于2023年4月1日正式实施。新的《2019年商标法》实施的“过渡期”是2020年10月1日至2023年3月31日；目前缅甸官方公布，在此基础上再增加一个短期的第二阶段“过渡期”，即2023年4月3日至2023年4月25日，以便更有利于在先申请人的知识产权保护。

在两个“过渡期”内，所有以前在登记制度下递交登记的商标以及即将在缅甸使用的商标都可以重新递交申请，早申请优先保护。如果在两个“过渡期”都没有申请的商标，可以从2023年4月26日开始，直接递交申请，所申请商标受新的商标法保护，遵循新的商标申请程序，按照新的商标法要求提供所需资料。

另外需要注意的是，在“过渡期”递交申请的商标，要求在规定的期限内及时补充递交经过公证的TM2表格，并缴纳官费；否则所有申请视为放弃，所申请的商标无效。所以优创信诺在这里提醒大家，尽快补充所需资料缴纳相关费用，让重新递交的申请真正进入有效状态，最终获得法律的保护，为企业开拓缅甸市场助力。
