中国船员与外国船东劳务合同纠纷的处理

一、准据法的适用(The application of applicable law)
中国船员与外国船东产生劳务纠纷,双方可选择适用中国法或者外国法。(For the labor disputes between Chinese seafarers and foreign shipowners, both have the rights to choose to apply Chinese law or foreign law.)
法律依据:《中华人民共和国涉外民事关系法律适用法》第三条 当事人依照法律规定可以明示选择涉外民事关系适用的法律。
二、船东以岗位调整为名安排船员离船,擅自缩短船员合同服务期限,船东对船员的工资损失承担责任。(The shipowner is liable for the loss of wages of his crew if he arranges the crew to disembark under the guise of job adjustment which aims to shorten the period of contract of his crew.)
《中华人民共和国民法典》第五百八十四条 当事人一方不履行合同义务或者履行合同义务不符合约定,造成对方损失的,损失赔偿额应当相当于因违约所造成的损失,包括合同履行后可以获得的利益;但是,不得超过违约一方订立合同时预见到或者应当预见到的因违约可能造成的损失。
三、船舶优先权(Maritime lien)
劳务纠纷一方申请船舶优先权的法院不予支持。(The court shall not support the application of a party to a labor dispute for maritime lien.)
法律依据:《中华人民共和国海商法》第二十八条船舶优先权应当通过法院扣押产生优先权的船舶行使。
