知识点一：何为涉外法律纠纷？

KNOWLEDGE POINT ONE: WHAT KIND OF DISPUTES(CASES) ARE FOREIGN-RELATED CASES?

Dear friends: In our foreign trade activities, what kind of disputes(cases) are  foreign-related cases? I will give you the answer! Let's learn Article 520!

最高法关于适用《中华人民共和国民事诉讼法》的解释：

第520条  有下列情形之一，人民法院可以认定为涉外民事案件：(一)当事人一方或者双方是外国人、无国籍人、外国企业或者组织的；(二)当事人一方或者双方的经常居所地在中华人民共和国领域外的；(三)标的物在中华人民共和国领域外的；(四)产生、变更或者消灭民事关系的法律事实发生在中华人民共和国领域外的；(五)可以认定为涉外民事案件的其他情形。

Article 520 Under any of the following circumstanse, the competent People’s court may determine a civil case as a foreign-related case:

1. Where one or both parties to the civil case are foreigners, stateless persons, or foreign enterprises or organizations.

2. Where the habitual residence of one or both parties are outside the territory of China.

3. Where the subject matter is located outside the territory of China.

4. Where the legal facts that give rise to, change or extinguish civil relations occur outside the territory of China.

5. Where the civil case falls under any other circumstances under which it may be determined as a foreign-related civil case.

知识点二：中国领域内的涉外纠纷程序适用的问题？

KNOWLEDGE POINT TWO: WHAT PROCEJURES WILL USE DEALING WITH FOREIGN-RELATED DISPUTES(CASES) IN CHINA?

小伙伴们，如果我们在对外贸易过程中产生了纠纷，只要是在我国领域内发生的纠纷，程序均适用我国民事诉讼法。

Dear friends: If the disputes occur in our foreign trade, the Chinese legal procejures will be applicated as long as the disputes are in the territory of China.

《中华人民共和国民事诉讼法》：

第二百六十六条 在中华人民共和国领域内进行涉外民事诉讼，适用本编规定。本编没有规定的，适用本法其他有关规定。

Article 266 The provisions of this Part shall be applicable to any civil lawsuit involving foreign interests within the territory of the PRC. Where it is not covered by the provisions of this Part, other relevant provisions of this law shall apply.
